Scouter — Terms of Service

1. Acceptance

By creating an account or otherwise using the Scouter app, web PWA, or any related service (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Who we are

The Service is provided by Asaf Pras ("we", "us"), based in Israel. Contact: aspras01@gmail.com.

3. The Service

Scouter is a personal collection tracker for the Dragon Ball Super Card Game. Features include card scanning, collection inventory, public collection sharing, wishlist alerts, and a paid Pro tier with extra capacity.

The Service is a fan tool. It is not affiliated with, endorsed by, or sponsored by Bandai, Toei Animation, Akira Toriyama, Bird Studio/Shueisha, TCGplayer, eBay, or any other rights-holder of the underlying card game. Card images and metadata are used under fair-use / nominative-use principles for catalogue identification.

4. Eligibility

You must be at least 13 years old (or older if your jurisdiction requires) to create an account.

If you are under 18, you confirm that a parent or legal guardian has reviewed these Terms and agrees on your behalf.

5. Your account

• You are responsible for keeping your sign-in credentials secure.
• You are responsible for activity that occurs under your account.
• One account per person.
• We may suspend or terminate accounts that we reasonably believe violate these Terms or applicable law.

6. Acceptable use

You agree NOT to:

• Reverse engineer, decompile, or attempt to derive source code from the Service except as permitted by law;
• Submit spam, malware, or content that infringes intellectual-property rights;
• Use automated tools (bots, scrapers) to access the Service in a way that exceeds normal personal-collection management;
• Attempt to bypass paywall, quota, or rate-limit mechanisms;
• Use the Service to harass, threaten, or impersonate any person;
• Use the Service for commercial resale or arbitrage operations without our prior written consent.

7. Subscriptions, billing, and refunds

7.1 Free tier

The free tier lets you add up to 20 cards per calendar month, browse catalogues, see public price ranges, and use one device for offline access.

7.2 Pro tier

• On the web and on Android, Pro is USD 5.00 per month (price excludes VAT/GST as applicable), sold as a recurring monthly subscription via Lemon Squeezy, our payments provider and Merchant of Record.
• In the iOS app, Pro is sold as an auto-renewable subscription through Apple's App Store, at the price shown in the App Store for your region. Payment is charged to your Apple ID. The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. You manage or cancel it in your App Store account settings. Refunds for App Store purchases are handled by Apple under Apple's terms.
• New users receive a 7-day free trial automatically, with no card on file. When the trial ends, Pro continues only if you subscribe.
• For subscriptions billed via Lemon Squeezy, you may cancel any time from Settings → Manage Subscription. Cancellation takes effect at the end of the current billing period.
• For subscriptions billed via Lemon Squeezy, we do not provide pro-rated refunds for partial months. If you believe you were charged in error, email aspras01@gmail.com within 14 days of the charge and we will review the case.
• Prices may change. We will give 30 days' notice in-app before any price increase affects your subscription.

7.3 Beta period

During the beta period, accounts flagged as beta testers receive Pro features at no cost. The beta flag may be removed when the App exits beta; affected users will be notified at least 14 days before any feature loss.

8. User content

You retain ownership of the data you create in Scouter (your collection list, wishlist, notes, share-link content). By enabling the public-collection share feature, you grant us a non-exclusive, royalty-free licence to host and display the shared collection at the URL you generate, for the duration that the share toggle is enabled.

9. Card images and price data

Card images are sourced from public catalogues (Bandai Card Game site, TCGplayer / TCGCSV) and rehosted at lower resolution for catalogue identification. We do not claim ownership of these images. Sale-price aggregates displayed in the App are derived from public marketplace listings and are presented "as-is" — they are not investment, financial, or trading advice.

10. Service availability

• The Service is provided on a best-effort basis. We do not guarantee uptime, error-free operation, or that the App will be free of bugs.
• We may modify, suspend, or discontinue all or part of the Service at any time. We will give reasonable advance notice of material changes that affect your existing subscription.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

We do not warrant that price data is accurate, complete, or current. Use the App at your own risk for any purchase / sale decisions.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR INTERRUPTION OF BUSINESS, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the limitation of certain warranties or liabilities; the above limits apply only to the extent permitted by law in your jurisdiction.

13. Indemnification

You agree to defend and indemnify us against any third-party claim arising from (a) your breach of these Terms, (b) your misuse of the Service, or (c) content you submit through the Service that infringes another party's rights.

14. Termination

You may terminate your account at any time via Settings → "Delete my account" or by emailing aspras01@gmail.com.

We may terminate or suspend your account if you breach these Terms, fail to pay a subscription, or violate applicable law. We will provide reasonable notice when feasible.

On termination:

• We will delete your personal data within 30 days (see Privacy Policy §7);
• Any outstanding subscription balance is non-refundable except where required by law;
• Sections 8–17 survive termination.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in-app at least 14 days before they take effect. Continued use of the Service after the change constitutes acceptance of the new Terms.

16. Governing law and disputes

These Terms are governed by the laws of the State of Israel without regard to its conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Service will be brought exclusively in the competent courts of Tel Aviv, Israel — to the extent permitted by mandatory law in your jurisdiction.
